This website (the “Website”) is the website of Cutler and Gross LTD (registered company no. 01001381) (“Cutler and Gross”, “we”, “us”), whose registered office is Unit A, 58-62 White Lion Street, N1 9PP, London, United Kingdom. When we refer to “you” and “your” we mean the user of the Website.

Access to this Website, all available services, and sunglasses and optical frames (the “Products”) is subject to the Terms and Conditions (the “Terms”) formed by this document together with the other documents referenced in this document. By using this Website you agree to be bound to these Terms that form a legally binding contract between Cutler and Gross and you. You should read these Terms carefully before placing an order on this Website. If you do not accept these Terms in their entirety you do not have permission to access the Website.

By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.

Cutler and Gross LTD has the discretion to modify the Terms of the Website. We suggest you refer to these Terms often, as by continuing to use the Website after any changes have been made you will be held to have accepted any changes.

These Terms govern our relationship with you and in accepting them you confirm that no other arrangement, agreement or representation applies. These Terms are governed by English law. Any dispute between us will be finally determined by the English courts and you agree to submit to the jurisdiction of those courts. If any provision in these Terms is held by a court to be unenforceable, that will not affect the remaining provisions of the Terms.

If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any Services. They provide us with the online e-commerce platform that allows us to sell our products and Services to you.

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.

You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).

You must not transmit any worms or viruses or any code of a destructive nature. A breach or violation of any of the Terms will result in an immediate termination of your Services.

We reserve the right to refuse Service to anyone for any reason at any time. You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks. You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the Service is provided, without express written permission by us.

The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

We are not responsible if information made available on this site is not accurate, complete or current. The material on this site is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete or more timely sources of information. Any reliance on the material on this site is at your own risk. This site may contain certain historical information. Historical information, necessarily, is not current and is provided for your reference only. We reserve the right to modify the contents of this site at any time, but we have no obligation to update any information on our site. You agree that it is your responsibility to monitor changes to our site.

Section 4 - modifications to the service and prices

Prices for our products are subject to change without notice. We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time. We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.

Section 5 - prohibited use

You must not misuse this Website. This Website, its Services and Products are for personal and non-commercial use only. We reserve the right to cancel any orders that appear to breach this understanding.

You must not obtain or attempt to obtain unauthorised access to the Website.

You must not use the Website to do anything misleading, malicious or otherwise unlawful including, but not limited to, sending any malicious code or any harmful or corrupt data or unsolicited communications. A breach of these terms is a violation of the Terms and Conditions and may constitute a criminal offence under the Computer Misuse Act 1990.

Section 6 - accuracy of billing and account information

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e‑mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

Section 7 - optional tools

We may provide you with access to third-party tools over which we neither monitor nor have any control nor input. 

You acknowledge and agree that we provide access to such tools ”as is” and “as available” without any warranties, representations or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.

Any use by you of the optional tools offered through the site is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s). We may also, in the future, offer new Services and/or features through the website (including the release of new tools and resources). Such new features and/or Services shall also be subject to these Terms of Service.

Certain content, products and Services available via our Service may include materials from third-parties.

Third-party links on this site may direct you to third-party websites that are not affiliated with us. We are not responsible for examining or evaluating the content or accuracy and we do not warrant and will not have any liability or responsibility for any third-party materials or websites, or for any other materials, products, or Services of third-parties.
We are not liable for any harm or damages related to the purchase or use of goods, Services, resources, content, or any other transactions made in connection with any third-party websites. Please review carefully the third-party's policies and practices and make sure you understand them before you engage in any transaction. Complaints, claims, concerns, or questions regarding third-party products should be directed to the third-party.

You agree that you will access the Website solely for your personal, non-commercial use. None of the contents of the Website may be downloaded, copied, reproduced, transmitted, stored, sold or distributed without the prior written consent from Cutler and Gross. Any content downloaded, copied or printed for commercial home use only will remain our property.

All copyright, trademarks and all other intellectual property rights in the Website and its content, which includes, without limitation, the website design, colour scheme, layout, text, images and all software and source codes, are owned by or licensed to us or otherwise used by us as permitted by law. You may not use this site, or any of its content, to further any commercial purpose whatsoever.

Section 10 - personal information and privacy

Your submission of personal information through the store is governed by our Privacy Policy, which can be viewed on the Privacy Policy page.

Section 11 - availability

All Products are subject to availability. We endeavour to inform you as soon as possible in the event that the Products in your order are unavailable. We take care to ensure that all content on the website including details, prices, and images of Products are accurate and correct at the time of posting, but this content is for your guidance only. All content is subject to change. We are not liable for any errors on the website.

We have taken care to display as accurately as possible the appearance, colours and finishes of our Products, but as monitors vary we are unable to guarantee that what you see is an accurate representation of the Products. No detail, price, or image of any of our Products shall form any part of the Terms and Conditions.

Section 12 - payment

Payment for all products and delivery charges will be taken once our warehouse is ready to ship your order. Payment for all Products must be made before dispatch.

Payment must be made by credit or debit card from a bank accepted by Shopify Payments. We accept Mastercard, VISA, and American Express credit and debit cards. We also accept payments by PayPal, Apple Pay, Google Pay, Clear Pay (UK only) and Klarna (UK only). We do not accept payment by cheque or other means.

If you give us any incorrect personal information, fail to make any payment when it is due, cancel any payment, or commit any breach of these Terms then, in any of those events, we have the right to cancel the Contract and recover possession of any Products which have been supplied for which payment has not been received in full.

Section 13 - price and VAT

For deliveries in the UK the price shown is inclusive of VAT.

Prices for delivery will be detailed before you enter your payment details.

For orders outside the UK and EU, you will be responsible for any local import taxes or customs duties. These charges are levied when the delivery reaches the delivery destination and you will be entirely responsible for payment of any such duties or taxes. Please note that we have no control over these charges and cannot predict their amount. Please contact your local customs office for further information before placing your order.

Please also note that you must comply with all applicable laws and regulations of the country for which the products are destined. We will not be liable for any breach by you of any such laws.

Section 14 - risk and ownership

Ownership of all Products remains with Cutler and Gross until full payment of all amounts due to us has been received. The risk of loss or damage to Products passes to you upon delivery. You will be responsible for the safe custody and insurance of all Products in your possession.

You must notify us promptly, and in any event within 48 hours of receipt, of any Products if they appear to be damaged in transit. In such circumstances, you must also keep all packaging, as this may be required when making a claim. We do not accept any responsibility for any wear and tear, accidental damage, or failure by you or by any third party to adhere to any written recommendation provided in relation to the Products.

All orders shipped require a signature for delivery. In the event that you opt out of signing for your parcel, you will be agreeing to release both the courier and Cutler and Gross of liability for any loss of damage that may result from delivering the shipment according to your request. 

In the event of returns, you must use a tracking service when sending back unwanted frames to Cutler and Gross. Please be aware that you are liable for the item(s) until we have confirmed that we have received it, and the item(s) has been confirmed in tact. In the event that the item does become lost in transit, you will be asked to produce the receipt of postage along with the tracking details of the item. If you are unable to produce a receipt of postage or tracking number you will be billed for the amount of the lost frames, and not receive a refund.

Section 15 - delivery

Cutler and Gross offers free delivery to most worldwide destinations. However, please note that for orders outside the UK and EU, customers are liable for any customs charges incurred once your order arrives at its destination. All orders are shipped via DHL with a signed-for service. Cutler and Gross does not take responsibility for any delays due to customs clearance or payment issues.

Please note, whilst we have confirmed your order, we won’t deduct payment until we are ready to ship. 

Please use the tracking service provided for accurate delivery dates. Although we can’t guarantee exact delivery times and dates (due to varying tax, customs and border screening processes worldwide) we are always happy to hear customer feedback on the performance of the delivery companies we use. Any feedback may be sent to help@cutlerandgross.com.

A dispatch confirmation containing your tracking number will be sent to the email address that you specified on your order.

Your Cutler and Gross order is important to us; to ensure that you receive your items safely we request that you have someone available to sign for delivery. For this reason, we are unable to send directly to PO addresses.

Section 16 - online returns

In the event that you are not satisfied with your purchase, you are welcome to request a full refund on any sunglasses, opticals, or accessories within 28 days of delivery. This means you have 28 days after receiving your item to request a return and ship it back. 

To be eligible for a refund, your item(s) must be in the same condition that they were received. Refund requirements below: 

  • The return request is accompanied by a valid receipt or invoice number.
  • The item(s) must not have been personalised or made to a customer’s specification.
  • The item(s) must be unworn and in their original, undamaged condition.
  • All items must be returned including the frame, case, and cleaning cloth.
  • In the case of opticals, the cost of prescription lenses cannot be refunded as these are made bespoke to each customer.

To request a return, contact Customer Care at help@cutlerandgross.com, the team will provide instructions on next steps. Alternatively, you can log into your account.

If your return is accepted, we’ll send instructions on where to send your parcel. Please note, Cutler and Gross do not cover the cost of returns, and will not refund the shipping costs. All returned goods remain the responsibility of the sender until received by Cutler and Gross. We recommend that you select a safe and traceable delivery service, retaining proof of postage.

Once your return has been received, a full refund will be processed. Please note it can take some time for your bank or credit card company to process and post the refund too.  If more than 7 business days have passed since we’ve approved your return, please contact us at help@cutlerandgross.com.

Section 17 - warranty

Whilst we endeavour to deliver all products in immaculate condition, you can rest assured that all eyewear distributed by Cutler and Gross comes with a warranty that covers manufacturer defects for two years from the date of purchase.

Our warranty guarantees that should any part of your frame be found defective due to manufacture, it will be repaired or replaced at no cost within two years of the delivery date. 

Please note that this warranty cannot be honoured if the frame is purchased outside of cutlerandgross.com or one of our stores – you must contact the stockist you purchased your frame from and check their individual policies.

Our prescription lenses purchased in-store are protected with a two-year warranty. All warranty claims must be accompanied by proof of purchase from a Cutler and Gross store.

Section 18 - image rights for wholesale

Any shared Cutler and Gross images should not be edited or manipulated by third party partners.

Cutler and Gross campaign images can only be used with the Cutler and Gross logo and for a limited period of six (6) months only from the distribution date in either March (for spring/summer) or October (for autumn/winter).

Section 20 - competitions and promotions

Please refer to the individual Terms attached to each promotion. Unless otherwise specified:

  • Promotions will only run for a specified time frame.
  • Promotions are not permitted to be used in conjunction with any other promotion, offer or competition.
  • Promotions are not open to anyone associated with the promotion, including employees, families or agents of Cutler and Gross and its associated companies.
  • Cutler and Gross may collect personal information for the purpose of administering the promotion. Cutler and Gross will use your details to keep you informed of relevant offers and other marketing communications (which you can unsubscribe from at any time). By providing your details you are providing your consent to these terms.
  • Cutler and Gross reserves the right to cancel, amend, terminate or temporarily suspend a promotion in the event of any circumstances outside its reasonable control. Your statutory rights are not affected. Cutler and Gross promotions are governed by English law and subject to the exclusive jurisdiction of the English courts.
Section 21 - errors, inaccuracies and omissions

Occasionally there may be information on our site or in the Service that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice (including after you have submitted your order).

We undertake no obligation to update, amend or clarify information in the Service or on any related website, including without limitation, pricing information, except as required by law. No specified update or refresh date applied in the Service or on any related website, should be taken to indicate that all information in the Service or on any related website has been modified or updated. 

Section 22 - disclaimer of warranties; limitation of liability

We do not guarantee, represent or warrant that your use of our Service will be uninterrupted, timely, secure or error-free. We do not warrant that the results that may be obtained from the use of the Service will be accurate or reliable. You agree that from time to time we may remove the Service for indefinite periods of time or cancel the Service at any time, without notice to you. You expressly agree that your use of, or inability to use, the Service is at your sole risk. The Service and all products and Services delivered to you through the Service are (except as expressly stated by us) provided 'as is' and 'as available' for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement. In no case shall Cutler and Gross - Dev ECom Store, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, Service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the Service or any products procured using the Service, or for any other claim related in any way to your use of the Service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the Service or any content (or product) posted, transmitted, or otherwise made available via the Service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

You agree to indemnify, defend and hold harmless Cutler and Gross LTD and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, Service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

Section 24 - severability

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

Section 25 - termination

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes. These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site. If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).

The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision. These Terms of Service and any policies or operating rules posted by us on this site or in respect to the Service constitutes the entire agreement and understanding between you and us and governs your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).
